1. ABOUT THESE TERMS
These Terms and Conditions ("Terms") govern your use of the TapCy mobile application and website (collectively, the "Platform") operated by:

(hereinafter referred to as "TapCy", "we", "us", or "our")
⚠️ CRITICAL NOTICE:
TAPCY IS A TECHNOLOGY PLATFORM ONLY. WE DO NOT PROVIDE TRANSPORTATION SERVICES.
All transportation services are provided by independent, licensed taxi operators in Cyprus. We simply connect passengers with drivers through our technology platform. We are an intermediary service - NOT a transportation company.
2. ACCEPTANCE OF TERMS
By downloading, accessing, or using the TapCy Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you must immediately cease using the Platform.
3. SERVICE DESCRIPTION
3.1 What TapCy Provides
We provide a digital marketplace platform that:
- Lists available independent taxi drivers in Cyprus
- Displays driver information (rates, vehicle type, ratings)
- Calculates estimated trip costs based on drivers' self-set rates
- Facilitates booking requests between passengers and drivers
- Provides communication tools
- Manages trip information and history
3.2 What TapCy Does NOT Provide
WE DO NOT:
- Provide transportation or taxi services
- Employ any drivers (all drivers are independent businesses)
- Own or operate any vehicles
- Set pricing for rides (drivers set their own rates)
- Process payments (payment is directly between you and driver)
- Guarantee driver availability
- Control how drivers operate their business
- Screen or background check drivers
- Supervise or manage drivers
3.3 Platform Operator Status
TapCy operates as an information society service provider under EU Directive 2000/31/EC. We are an intermediary platform facilitating connections between independent parties.
3.4 Business and Provider/Agency Role Boundaries
The Platform may also be used by business users (for example, hotels or corporate accounts) and provider/agency users.
- Business users use TapCy as a booking coordination tool for faster service arrangement.
- Provider/agency users use TapCy to manage and present groups of independent drivers.
- Neither business users nor provider/agencies become transportation operators through TapCy by default.
- Transportation services remain the sole responsibility of the independent driver or licensed transport operator performing the trip.
4. ELIGIBILITY AND REGISTRATION
4.1 Age Requirement
You must be at least 18 years old to use this Platform.
4.2 Account Creation
To use certain features, you must create an account by providing:
- Full name
- Email address
- Phone number
- No payment card details are required for passenger account creation under the current model
4.3 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities under your account
- Notifying us immediately of unauthorized use
4.4 Accurate Information
You must provide accurate, current, and complete information. Providing false information may result in account termination.
5. HOW THE PLATFORM WORKS
5.1 Booking Process
Step 1: You enter pickup and destination locations
Step 2: Platform calculates trip distance and duration using mapping services
Step 3: Platform displays available drivers nearby with:
- Driver's name and photo
- Vehicle type
- Rating (based on previous passenger reviews)
- Price calculated using driver's pre-set per-kilometer rate
Step 4: You select a driver based on:
- Price (drivers set their own rates)
- Rating
- Proximity
- Vehicle type
Step 5: Booking request is sent to selected driver
Step 6: Driver may accept or decline the request
Step 7: If accepted, you receive driver's contact information and vehicle details
Step 8: Driver picks you up and provides transportation service
Step 9: You pay the driver directly (cash or as arranged with driver)
Step 10: You may rate and review the driver
5.2 Pricing Transparency
IMPORTANT - HOW PRICING WORKS:
- Each driver sets their own pricing structure (per-kilometer rate, base fare, etc.)
- These rates are stored in the driver's profile
- When you request a trip, the Platform calculates the estimated cost using:
- Driver's per-km rate × trip distance
- Driver's base fare (if applicable)
- Driver's per-minute rate (if applicable)
- The Platform does NOT set prices - it only calculates using the driver's rates
- Different drivers have different rates - you can compare and choose
- Final price may vary based on actual route, traffic, tolls, or waiting time
- Any price adjustments must be agreed directly with the driver
5.3 No Guaranteed Availability
We do not guarantee:
- That drivers will be available in your area
- That any driver will accept your booking request
- The timing of driver acceptance or arrival
- Continuous or uninterrupted Platform access
6. PAYMENT
6.1 Direct Payment to Drivers
Currently, all payments are made directly to the driver, not through the Platform. You may pay by:
- Cash
- Card (if driver has payment terminal)
- Other methods as agreed with the driver
6.2 Platform Fees
The Platform is currently free for passengers. We may introduce booking fees or service charges in the future with 30 days notice.
TapCy may charge software usage commissions (typically percentage-based) to participating drivers, provider/agencies, or business partners under their separate commercial agreements. These software commissions do not change TapCy's status as a technology intermediary and not a transportation provider.
6.3 No Payment Processing
TapCy does NOT currently process payments. We are not involved in:
- Collection of fares
- Payment disputes
- Refunds
- Chargebacks
All payment matters are between you and the driver.
Regulatory notice: TapCy does not currently provide regulated online payment or e-money services in Cyprus. If in-app payment features are introduced in the future, they will only be enabled after obtaining required licenses/authorizations or partnering with appropriately authorized providers.
7. CANCELLATIONS
7.1 Before Driver Accepts
You may cancel your booking request at any time before a driver accepts, with no penalty.
7.2 After Driver Accepts
If you cancel after driver acceptance:
- Driver's cancellation policy applies
- Driver may charge a cancellation fee (if disclosed)
- Repeated cancellations may result in account restrictions
7.3 Driver Cancellation
Drivers may also cancel bookings. If this occurs frequently, you may report the driver.
8. PASSENGER CONDUCT AND OBLIGATIONS
8.1 You Must:
✓ Provide accurate pickup location and destination ✓ Be ready at agreed pickup time ✓ Treat drivers with respect and courtesy ✓ Follow reasonable driver instructions ✓ Pay the agreed fare ✓ Comply with local laws and regulations ✓ Not damage the vehicle or property ✓ Use appropriate language and behavior
8.2 You Must NOT:
✗ Bring illegal substances, weapons, or prohibited items ✗ Consume alcohol or smoke without driver permission ✗ Harass, threaten, or abuse the driver ✗ Bring more passengers than vehicle capacity ✗ Use the Platform for illegal purposes ✗ Provide false information ✗ Leave belongings intentionally ✗ Distract the driver while driving
8.3 Special Requests
For special needs (wheelchair accessibility, child seats, pet transport), you should:
- Communicate with driver before trip
- Confirm driver can accommodate
- Understand that drivers may decline special requests
9. SAFETY
9.1 Your Safety Responsibility
YOU are responsible for your own safety. This includes:
- Verifying driver identity before entering vehicle
- Checking that vehicle matches Platform information
- Wearing seatbelts
- Following safety instructions
- Trusting your instincts - if something feels wrong, do not enter the vehicle
9.2 Safety Features
The Platform may provide:
- Driver photo and vehicle information
- GPS tracking during trip
- Emergency contact features
- Trip sharing with friends/family
However, we cannot guarantee your safety and are not responsible for driver actions.
9.3 Reporting Issues
If you experience safety issues, you should:
- Contact local authorities immediately (police: 112 in Cyprus)
- Report to TapCy at support@tapcy.app
- Provide trip details and driver information
10. LIMITATION OF LIABILITY
10.1 Platform "As Is"
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant:
- Platform will be uninterrupted, secure, or error-free
- Information will be accurate or complete
- Defects will be corrected
- Platform is free of viruses or harmful components
10.2 No Liability for Transportation Services
CRITICAL DISCLAIMER:
TAPCY IS NOT A TRANSPORTATION PROVIDER AND ASSUMES NO LIABILITY FOR:
- Actions, omissions, or negligence of drivers
- Quality or safety of transportation services
- Accidents, injuries, or death during trips
- Property damage or loss
- Lost or stolen belongings in vehicles
- Driver misconduct or illegal activity
- Vehicle condition or mechanical failures
- Route taken or trip duration
- Driver's compliance with laws or regulations
All transportation services are provided by independent third-party drivers. Any claims must be directed to the driver or their insurance company.
10.3 Maximum Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPCY'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE PLATFORM SHALL NOT EXCEED €50 (FIFTY EUROS).
10.4 Indemnification
You agree to indemnify and hold harmless TapCy, its directors, employees, and affiliates from any claims, damages, or expenses arising from:
- Your use of the Platform
- Your violation of these Terms
- Your violation of any rights of others
- Your conduct during transportation services
11. DRIVER INDEPENDENCE
11.1 Independent Contractors
ALL DRIVERS ARE INDEPENDENT BUSINESS OPERATORS.
Drivers are NOT:
- Employees of TapCy
- Agents or representatives of TapCy
- Under TapCy's control or direction
- Entitled to employment benefits from TapCy
11.2 Driver Responsibilities
Each driver is independently responsible for:
- Obtaining and maintaining all required licenses and permits
- Maintaining appropriate insurance coverage
- Vehicle maintenance and safety
- Tax obligations and compliance
- Their own business operations
- Setting their own working hours and rates
- Complying with all applicable laws
11.3 No Screening Guarantee
While drivers should maintain proper licenses and insurance, TapCy does not conduct background checks, verify credentials, or guarantee driver compliance with legal requirements.
It is ultimately your responsibility to verify driver credentials if desired.
12. RATINGS AND REVIEWS
12.1 Your Reviews
After each trip, you may:
- Rate the driver (1-5 stars)
- Leave written feedback
- Report issues or problems
12.2 Review Guidelines
Reviews must be:
- Honest and accurate
- Based on your actual experience
- Not defamatory or abusive
- Not discriminatory
- Not containing personal attacks
12.3 Consequences of Reviews
- Low-rated drivers may be suspended or removed
- We reserve the right to remove inappropriate reviews
- Reviews are visible to other passengers
13. INTELLECTUAL PROPERTY
13.1 TapCy Ownership
All Platform content, including but not limited to:
- Software and code
- Logo, trademarks, and branding
- Design and user interface
- Text, graphics, and images
is owned by TapCy or licensed to us and protected by intellectual property laws.
13.2 Limited License
We grant you a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes.
You may NOT:
- Copy, modify, or distribute Platform content
- Reverse engineer or decompile software
- Remove copyright or trademark notices
- Use our trademarks without permission
- Create derivative works
14. PROHIBITED USES
You may not use the Platform to:
- Violate any laws or regulations
- Infringe intellectual property rights
- Transmit viruses or malicious code
- Harass, abuse, or harm others
- Impersonate any person or entity
- Collect user information without consent
- Interfere with Platform operation
- Use automated systems (bots, scrapers) without permission
- Create fake accounts or manipulate ratings
- Engage in fraudulent activity
- Resell or commercialize Platform access
Violation may result in account termination and legal action.
15. PRIVACY AND DATA PROTECTION
15.1 Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data in compliance with GDPR.
15.2 Data You Provide
By using the Platform, you consent to:
- Collection of location data during trips
- Storage of trip history and preferences
- Sharing necessary information with drivers for service provision
- Processing of data as described in Privacy Policy
15.3 GDPR Rights
As an EU user, you have rights to:
- Access your personal data
- Correct inaccurate data
- Request deletion of data
- Object to certain processing
- Data portability
- Lodge complaints with supervisory authorities

16. MODIFICATIONS TO TERMS
16.1 Right to Modify
We reserve the right to modify these Terms at any time.
16.2 Notice of Changes
We will notify you of material changes by:
- Email to your registered address
- Notification within the Platform
- Posting updated Terms with new "Last Updated" date
16.3 Continued Use
Continued use of the Platform after changes constitutes acceptance of modified Terms. If you do not agree, you must stop using the Platform.
17. ACCOUNT TERMINATION
17.1 Termination by You
You may terminate your account at any time by:
- Contacting support@tapcy.app
- Using account deletion feature in Platform
17.2 Termination by Us
We may suspend or terminate your account immediately if you:
- Violate these Terms
- Engage in illegal or fraudulent activity
- Abuse or harass drivers
- Provide false information
- Damage our reputation or business
- Repeatedly cancel bookings
- Have outstanding payment disputes
17.3 Effect of Termination
Upon termination:
- Your right to use Platform ceases immediately
- We may delete your account data (subject to legal retention requirements)
- Outstanding obligations survive termination
- Provisions regarding liability and indemnification survive
18. DISPUTE RESOLUTION
18.1 Informal Resolution
Before taking legal action, please contact us at support@tapcy.app to attempt informal resolution.
18.2 Mediation
If informal resolution fails, parties agree to attempt mediation in good faith before litigation.
18.3 Court Proceedings
If informal resolution and mediation do not resolve a dispute, either party may proceed before the competent courts stated in these Terms.
19. GOVERNING LAW AND JURISDICTION
19.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the Czech Republic.
19.2 Jurisdiction
Any disputes arising from these Terms or use of the Platform shall be subject to the exclusive jurisdiction of the courts of Prague, Czech Republic.
19.3 Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable EU consumer protection laws.
20. GENERAL PROVISIONS
20.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TapCy regarding the Platform.
20.2 Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
20.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
20.4 Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations to affiliates or in connection with a merger, acquisition, or sale of assets.
20.5 Force Majeure
We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, strikes, internet outages, or government actions.
20.6 Survival
Provisions that by their nature should survive termination shall survive, including warranties, disclaimers, indemnification, and limitations of liability.

22. LANGUAGE
These Terms are provided in English. In case of any discrepancy between English and translated versions, the English version shall prevail.
